Best Party Hire – Terms and Conditions of Business

1. General
a. Definitions
- Equipment: Items and accessories hired out, including goods and services sold by Best Party Hire.
- Hirer: The individual, company, or organization hiring equipment or purchasing goods from Best Party Hire.
- Best Party Hire: Refers to the business entity “Best Party Hire.”
- Admin Fee: The initial payment of £25 required to secure a booking.
- Balance Due: The remaining amount payable for the booking.
Any condition deemed invalid will not affect the validity of other conditions. Nothing in this contract limits a consumer’s existing legal rights.
b. Extent of Contract and Cancellation
This contract is not transferable and becomes effective upon Best Party Hire’s acceptance of the Hirer’s order.
c. Termination
Best Party Hire reserves the right to terminate the contract and repossess equipment if:
- The Hirer breaches any terms of this contract or the provided safety instructions.
- The Hirer becomes insolvent or is otherwise unable to fulfill contractual obligations.
d. Ownership of Equipment and Goods
- All hired equipment remains the property of Best Party Hire.
- Ownership of purchased goods transfers to the Hirer only upon receipt of full payment.
e. Jurisdiction
This contract is governed by the laws of England, and both parties agree to submit to the exclusive jurisdiction of the English Courts.
f. Amendments
Best Party Hire reserves the right to make reasonable amendments to this contract without prior notice.
2. Hire Charges
a. Basis of Charging
Hire charges quoted in the confirmation email are valid for the duration of the contract. Additional fees, including the Admin Fee, are detailed on Best Party Hire’s website and are subject to change.
b. Transport and Setup Charges
Best Party Hire includes delivery, setup, and collection in its pricing. However, extra charges may apply in the following situations:
- If the Hirer is unavailable at the agreed delivery or collection time.
- If the Hirer changes the booking’s date, time, or location without prior agreement.
c. Cleaning and Damage Repair
The Hirer is responsible for any cleaning or repairs required due to misuse or damage of the equipment.
d. Loss of Equipment
Equipment unavailable for collection will be treated as lost. The Hirer will be charged for replacement, lost revenue, and £20 per day plus the daily hire rate until payment is received.
e. Waiting Time and Access
Additional fees may apply for delays caused by:
- Waiting for the Hirer at the time of delivery or collection.
- Difficult or unsuitable access routes causing delays or additional work.
3. Payment
a. Payment Terms
Best Party Hire reserves the right to cancel the contract if payments are not made on time.
b. Admin Fee
- The Admin Fee secures the date, time, and equipment for the Hirer. This fee is non-refundable.
- The Hirer must pay the Admin Fee within 48 hours of booking confirmation.
c. Balance Due
- The remaining balance is due 14 days before the booking date.
- Failure to pay within 48 hours of the due date may result in cancellation of the booking.
4. Refunds
a. Cancellations
- Cancellations must be made via email before the booking date.
- The Admin Fee is non-refundable but can be used as store credit for up to one year.
b. Balance Refund Policy
- Cancellations within 7 days of the booking date: No refund.
- Cancellations between 14 and 7 days: 50% refund of the remaining balance.
- Cancellations over 14 days before the booking date: Full refund of the remaining balance.
c. Acts of God/Unforeseen Circumstances
Best Party Hire reserves the right to cancel bookings due to unforeseen circumstances (e.g., illness, extreme weather). In such cases, all payments will be refunded.
5. Hirer’s Responsibilities
a. Inspection and Receipt of Equipment
The Hirer must inspect and sign for equipment upon delivery. Any issues must be reported immediately.
b. Delivery and Collection
- The Hirer must ensure adequate access for delivery and collection.
- Best Party Hire is not liable for property damage during transportation.
c. Security of Equipment
The Hirer is responsible for equipment security until collection and must not sell, alter, or modify it.
d. Suitable Space
The Hirer must provide a suitable space for the equipment as advised during booking.
e. Safe Use of Equipment
- The Hirer is responsible for the safe and correct operation of equipment in accordance with provided safety instructions.
- Any non-Best Party Hire equipment used with hired equipment must comply with safety standards.
f. Loss or Theft
- The Hirer is responsible for insuring the equipment against loss, theft, or damage.
- Any replacement equipment purchased using insurance proceeds will remain the property of Best Party Hire.
g. Compliance with Government Guidelines
The Hirer must adhere to relevant government restrictions. Any cancellations due to such restrictions will follow the refund terms in Section 4.
6. Best Party Hire’s Responsibilities
a. Hire Rates
Best Party Hire will honor agreed hire rates for the duration of the contract.
b. Safety and Operation Instructions
Best Party Hire will provide appropriate written and practical instructions for equipment use.
c. Equipment Testing
All equipment will be tested and inspected prior to the hire period.
d. Delivery and Collection
Best Party Hire will make every effort to deliver and collect equipment on time.
e. Returned Goods
Unused goods purchased for use with equipment may be returned for credit as agreed.
f. Limitation of Liability
Best Party Hire is not liable for unforeseen financial losses caused by delays, non-delivery, or equipment issues.
7. Video Recording and Photography
a. Consent and Notification
The Hirer acknowledges and agrees that Best Party Hire (and/or its authorized representatives) may record video footage and/or take photographs at the venue during the hire period. Such recordings may be used for, but are not limited to, marketing, promotional, training, or quality-assurance purposes. If the Hirer objects to video recording or photography at the event, a written notification must be submitted to Best Party Hire at least 7 days prior to the booking date.
b. Permissions and Responsibilities
It is the Hirer’s responsibility to ensure that any necessary permissions or consents (including from the venue owner or manager, and from participants and guests) have been obtained for such recordings. Best Party Hire will not be liable for any claims arising from failure to secure these permissions.
c. Usage and Ownership
All video and photographic materials captured by Best Party Hire remain the property of Best Party Hire. Best Party Hire reserves the right to store, edit, reproduce, publish, and distribute these materials in any media format for the purposes described in Section 7(a). The Hirer and event participants shall not be entitled to any compensation or fee for the use of such materials.
d. Data Protection and Privacy
Best Party Hire will handle any personal data that may appear in video or photographic materials in accordance with applicable data protection laws. Any request to remove or cease using footage or photographs that prominently feature an individual should be made in writing and will be considered on a case-by-case basis.
e. Face Blurring
By default, Best Party Hire will blur the faces of all individuals appearing in video footage that is used for marketing or promotional purposes to protect personal privacy. If the Hirer or any individuals prefer not to have their faces blurred (i.e., to appear clearly in published materials), explicit written consent from those individuals must be provided to Best Party Hire prior to publication.
f. Opt-Out Requests
Where reasonable and practical, Best Party Hire will make commercially reasonable efforts to honor requests from individuals who do not wish to be recorded or photographed at all. However, Best Party Hire cannot guarantee the complete exclusion of any individual from all footage or photographs, particularly in group or crowd scenes.
